Feet of Fines - Malhamdale (1486-1603)
Feet of Fines are records showing the transfer of land and property and the originals are kept at the National Archives, Kew in the record series CP25/1 and CP25/2. They provide some insight into who owned the land in Malhamdale, as they are useful for finding the names of who owned land, but less helpful in providing information about the properties and land involved.
This definition is taken from The National Archives Research Guide no. 140:
Fines, or Final Concords, were conveyances of land by means of a legal action (normally fictitious after 1300), that resulted in a copy of the final agreement, or concord, between the purchaser, known as the querent, and the seller, known as the deforciant, being filed with the records of the king's court and open to public inspection. This final agreement was normally written out three times on a single sheet of parchment - two copies side by side and one copy across the bottom of the sheet, separated by an indented or wavy line. The purchaser kept one copy, the seller the other and the final copy - 'the foot of the fine'- was kept by the court as a central record of the conveyance. It was a means of having title registered to guard against subsequent fraud or forgery as copies if this three piece jig-saw would only fit together if genuine. There was no legal obligation to have title registered in this way. Often the fine is one of a series of conveyancing deeds some of which may give more detail about the property - such private deeds are less likely to have survived with the public records
Final concords were written in Latin until 1733 and the Yorkshire Archaeological Society (YAS) has done an excellent job in transcribing and publishing the Feet of Fines from the 12th century up until 1645. You can find a complete listing of all these YAS and other related publications on the MedievalGenealogy.org website.
Feet of Fines of the Tudor period (1486-1603)
The YAS Tudor series of transcripts edited by Francis Collins were published at the end of the 19th century:
Part 1 (1486-1571) - YAS Record Series Vol 2 pub 1887
part 2 (1571-1583) - YAS Record Series Vol 5 pub 1888
part 3 (1583-1594) - YAS Record Series Vol 7 pub 1889
part 4 (1594-1603) - YAS Record Series Vol 8 pub 1890
As these Tudor Fines neatly extend backwards from the earliest existing parish registers, they can prove useful to genealogists, who may well find their early ancestors listed in these land transfers and below is an extract of the Malhamdale entries from the four YAS volumes covering the Tudor period.
There may be some ommissions or mistakes, as the early spellings don’t make it easy to distinguish between Calton, Carleton in Craven or the various other Yorkshire Carltons, and similarly Coniston Cold is easily confused with entries for Conistone with Kilnsey and other Yorkshire Conistons.
You can find complete versions of all 4 volumes of the Tudor Feet of Fines for Yorkshire on the British History Online website.
